The original, the register copy, and the People's Committee
A Vietnamese birth certificate (giấy khai sinh) is issued by the People's Committee of the commune or ward where the birth was registered. The family keeps the original (bản chính); the registry issues copies extracted from the register (bản sao trích lục) when another is needed. Both are ordinary, and both are translated in full, including the registration number and book.
The household registration book (sổ hộ khẩu) that proved family relationships for decades was abolished from 2023 in favour of the national population database, so newer files carry a residence confirmation instead; older books are still translated when submitted. Diacritics, Văn and Thị
Vietnamese names run family name, middle name, given name — Nguyễn Thị Lan — and the diacritics are part of the spelling: stripping them can turn one name into several possible ones. We keep them as the document writes them, and where a US document already uses a stripped spelling we follow your passport or the spelling you give us and keep it consistent.
Middle names such as Văn and Thị traditionally mark a man and a woman and are part of the legal name; US forms that drop a middle name drop them too, so the translation keeps them visible.
Judicial record certificates No. 1 and No. 2
Vietnam's police certificate is the Judicial Record Certificate (Phiếu lý lịch tư pháp) issued by the Department of Justice. It comes as No. 1, which can omit spent convictions, and No. 2, which lists the full record; immigration offices generally ask for No. 2. The number is printed on it and translated. Is a certified Vietnamese translation accepted by USCIS?
Yes. USCIS asks for a complete English translation and the translator's certification that it is accurate (8 CFR 103.2(b)(3)); every translation carries that signed certification, and acceptance is guaranteed or your money back.
Is a register copy (bản sao) acceptable?
It is an official copy issued from the register and is routinely used. We translate it in full.
Which judicial record certificate do I need?
For immigration, usually No. 2, which shows the full record. Check with the office before ordering.
