The red book, and what it certifies

Vietnamese land belongs to the people with the state as representative, so what exists is a land use right certified by the Giấy chứng nhận — the "red book", or the older "pink book" for housing.

Since 2009 a single unified certificate covers land use rights and assets attached to the land. The certificate states the form of use, the purpose and the term, and those three fields are the substance.

The purpose of use, which cannot simply be changed

Every parcel has a designated purpose — residential, annual cropland, perennial cropland, production forest — and building on agricultural land without conversion is unlawful.

Conversion requires state approval and payment. A buyer who reads "land" without the purpose field misjudges what can be done with it, so we translate it prominently.

Term, and the difference between land types

Residential land use is long-term and stable with no expiry for individuals, while agricultural and project land runs for a fixed term — commonly fifty years — after which extension is applied for.

So two Vietnamese certificates can look alike and mean very different things. We put the term and its start date in the translation.

Households, spouses and names

A certificate may be issued to a household (hộ gia đình) rather than an individual, which means every member with land use rights at the time has an interest — a frequent source of dispute on sale.

Both spouses' names are required on a certificate for marital property. Names run family name first and diacritics distinguish different words. See our Vietnamese page.
