Notarised or certified, and they are different offices
Vietnam distinguishes công chứng, notarisation by a notary office, from chứng thực, certification by a People's Committee at ward or district level, and the two carry different weight.
A power for a property transaction needs notarisation. A ward certification of a signature is a lesser act and is refused where the statute requires the first. We name which the document carries.
Consular powers, and the diaspora
Vietnamese embassies and consulates perform notarisation for use in Vietnam, and with a very large US diaspora that is the normal route for house sales, inheritance and land-use rights handled by relatives at home.
A power notarised before a US notary and apostilled is generally not what a Vietnamese office expects. We name the issuing office because the route decides whether the document works.
Land use rights, not ownership
Vietnamese law vests land in the state and grants land use rights evidenced by a certificate, the "red book" or "pink book" depending on the era.
A power that a US reader would call a power to sell land is in fact a power over land use rights, and translating it as ownership misstates the legal position. We keep the distinction.
Names, diacritics and the ID number
Vietnamese names run family name, middle name, given name, and the given name is the one used in address — Nguyễn Văn An is addressed as An.
Diacritics distinguish different words entirely, and stripping them can change a name. Parties are identified by a twelve-digit citizen identification number. See our Vietnamese page.
