Giám định tư pháp — judicial assessment
Vietnamese expert evidence is giám định tư pháp, judicial assessment, carried out by assessors and organisations appointed under a dedicated law, with a register of judicial assessors maintained by the state.
So an assessor is a licensed and registered person or organisation rather than any qualified professional, and the report states the registration. We reproduce it.
The forensic institutes
Vietnam operates a National Institute of Forensic Medicine, a forensic psychiatry institute, and provincial centres, and the criminal police have their own technical department.
A report from a provincial centre and one from the national institute carry different weight, and re-assessment at the national level is available where a provincial finding is contested. We name the institution.
Re-assessment, and the sequence
A party may request re-assessment or an additional assessment, and a file may hold successive reports from different institutions with the later one operative.
