No legal separation, and mandatory reconciliation
Vietnamese law provides no legal separation. Divorce is by court, and the court must first attempt reconciliation — a mandatory step, conducted at the court or referred to the commune, before the case proceeds.
So a Vietnamese file contains a reconciliation record as well as a judgment, and the reconciliation minute is part of the procedure rather than evidence that the couple reconciled.
Agreed divorce is still a court matter
Even where both spouses agree, a Vietnamese divorce goes through the People's Court, which issues a decision recognising the agreement rather than a judgment after trial.
A recognition decision and a judgment look different and carry the same effect. We name which the document is and reproduce the case number and the court.
When the decision takes effect
A Vietnamese court decision takes effect on a stated date, and a recognition of an agreed divorce is effective immediately while a contested judgment is subject to appeal periods.
A decision without a certificate of legal effect may not be usable abroad, and that is the commonest defect in a Vietnamese family-law packet. Check for it before ordering.
The civil status book, and the diacritics
The divorce is recorded in the civil status book at the People's Committee, and a trích lục — an extract — can be issued showing the entry.
Vietnamese marks tone with diacritics and stripping them changes names. Roughly two in five Vietnamese share the surname Nguyễn, so the full name with diacritics is what identifies the parties. See our Vietnamese page.
