No legal separation, and divorce at the amphoe
Thai law provides no legal separation. Where both spouses agree, divorce is registered at the district office (amphoe) by signing a divorce agreement in front of two witnesses and having it registered — no court at all.
The district office issues a divorce certificate and records the divorce against the marriage registration. A US reader expecting a decree receives a registration certificate, and that is the operative document.
The divorce agreement is the substance
The agreement registered alongside deals with property, children and maintenance, and Thai practice puts the substance there rather than in a judgment.
So the certificate proves the divorce and the agreement proves the terms, and a file with only the certificate proves half of it. We translate both.
Contested divorce, and the grounds
Where the parties do not agree, divorce is judicial on statutory grounds including separation for a defined period, and the court judgment must then be registered at the district office to take effect.
So a judgment alone is not the end. The registration is what changes the record, and applicants routinely send the judgment without it.
