Two court systems, by religion
Indonesian divorce runs through two separate court systems: the Religious Court (Pengadilan Agama) for Muslims and the District Court (Pengadilan Negeri) for everyone else. There is no legal separation in either.
Which court issued the decision tells a reader the parties' religion and which body of law applied. We name the court exactly rather than writing "an Indonesian court".
Talak and gugat cerai
In the Religious Court, a husband petitions for cerai talak and a wife for cerai gugat, and the procedures and consequences differ — including a pronouncement session the husband must attend.
The court issues an akta cerai, a divorce certificate, after the decision is final, and that certificate is what evidences the divorce. A decision without the akta cerai evidences an incomplete process.
The marriage record, and Dukcapil
Non-Muslim marriages are recorded by Dukcapil, the civil registration office, which annotates the marriage certificate on divorce; Muslim marriages are recorded by the KUA, the religious affairs office.
So where the marriage record sits depends on religion too, and a US office asking for an annotated marriage certificate needs to be pointed at the right body.
Single names, and the NIK
A great many Indonesians have a single legal name, and court documents reproduce it as it is. A US form demanding two fields forces a split that differs between documents.
