Divorce at a notary since 1994
Cuba has allowed divorce by notarial deed where both spouses agree since 1994, so a Cuban divorce is frequently an escritura before a notary rather than a court judgment. Contested cases go to court.
There is no legal separation as a distinct status. A US office expecting a decree may receive a notarial instrument, which is fully effective, and we name the notary and the deed number.
The 2022 Family Code
Cuba adopted a new Family Code by referendum in 2022, substantially rewriting marriage, parental responsibility and related institutions.
So documents from before and after rest on different law and use different terminology. We reproduce the code and article the instrument cites rather than modernising it.
The Registro del Estado Civil
The dissolution is recorded against the marriage entry in the Registro del Estado Civil under the Ministry of Justice, and a certificación literal — a full transcription including marginal annotations — shows it.
A short extract omits the annotations. For a separation or divorce you need the literal, and people routinely order the short one.
Legalisation, and the carné
Cuba is not a party to the Hague Apostille Convention, so documents for the United States go through consular legalisation, and those stamps are pages of the packet we translate.
