Separación, and the conversion to divorce
Guatemala provides separación, judicial or by mutual consent, which suspends cohabitation and dissolves the property regime while leaving the marriage in existence, and after a year either spouse may convert it into divorce.
So a Guatemalan file commonly contains a separation and a later conversion, and the conversion is the document that ends the marriage. A reader who stops at the separation has the status wrong.
The notarial route, and voluntary jurisdiction
Guatemalan law allows a consensual separation or divorce to be processed in voluntary jurisdiction before a notary, who issues the instrument, and the parties may also proceed judicially.
A notarial instrument is a public document with full effect. We name the notary and the registry reference rather than describing it as an agreement.
RENAP records it
The dissolution is recorded by RENAP against the marriage inscription, and a certificate issued afterwards carries the annotation.
RENAP took over from the municipalities in the late 2000s and migrated older records, so a certificate may restate an entry originally made in a municipal book. We name both layers where the document shows them.
The CUI, and Maya surnames
The CUI, the thirteen-digit code on the DPI, does not change and is the cross-check across a Guatemalan file.
