Unilateral divorce since 1988

Nicaragua introduced unilateral divorce — divorce at the request of one spouse without stating grounds — in 1988, and the 2014 Family Code carried it forward. That makes separation as a distinct status largely redundant.

So a Nicaraguan file usually contains a divorce rather than a separation, and a separation instrument is likely to be older or a property arrangement. We name which the document is.

The Family Code, and the family courts

The 2014 Código de Familia created specialised family courts and reorganised the procedures, so documents from before and after rest on different law and use different terminology.

We reproduce the code and article the instrument cites rather than modernising it. Notarial divorce by mutual consent without minor children is also available.

Municipal registries, and the central record

Births and marriages are registered by the municipal Registro del Estado Civil de las Personas, with a central record under the Consejo Supremo Electoral, and the dissolution is annotated against the municipal marriage entry.

We name the municipality and transcribe the tomo, folio and asiento. Many older entries are handwritten and we transcribe what is legible.

The cédula, and the Caribbean coast

The cédula number encodes the municipality of registration and the date of birth with a check letter, and it does not change.
