Separación judicial, and divorce since 1991

Paraguay legalised divorce in 1991 — one of the last countries in the region to do so — and the Civil Code provides separación judicial de cuerpos alongside it, which suspends cohabitation while the marriage continues.

A marriage that ended before 1991 ended by nullity or simply persisted, so a Paraguayan file from that period may show a couple separated for decades with no dissolution. That is the law as it then stood.

The conversion, and the property regime

A separation may be converted into divorce after a period, and it dissolves the comunidad de gananciales — the marital property regime — which is a separate consequence from the personal one.

A couple may therefore be separated with the property divided and still married. We name the instrument and what it decided.

The Registro del Estado Civil

The dissolution is recorded against the marriage entry at the Dirección General del Registro del Estado Civil under the Ministry of Justice, and a certificate issued afterwards carries the annotation.

Older entries are handwritten in district books and the marginal note may be handwritten too. We transcribe it where it sits rather than guessing at an illegible word.

The cédula, and Guaraní

The cédula de identidad civil number, issued by the police identification department, stays with the person and is the cross-check across the file.
