The Family Code, and separación
El Salvador's Código de Familia provides for separation of the spouses as a ground and a consequence, and for divorce by mutual consent, by separation for a year, and on fault grounds.
Separation for one year is itself a ground for divorce, so the date separation began is consequential and appears in the instrument. We reproduce it.
The notarial route, and the family courts
Consensual matters may be processed in voluntary jurisdiction before a notary, and contested ones go to the specialised family courts created by the Family Code.
A notarial instrument is a public document with full effect. We name the notary and the reference rather than describing it as an agreement.
The municipal registry records it
Marriages are registered by the Registro del Estado Familiar of the municipality, and the dissolution is annotated against that entry.
So a Salvadoran marriage certificate is issued by a town hall rather than a national agency, and the annotated certificate is what should be sent. We name the municipality as printed.
The DUI, and older colón documents
The DUI number, nine digits, stays with the person and is the cross-check across the file. It doubles as the tax identifier in most current documents.
