Separación conyugal, and the notarial divorce
Ecuador provides separación conyugal judicialmente autorizada, which suspends cohabitation while the marriage continues, and it is little used because divorce is readily available.
Since 2006 a consensual divorce with no minor children may be done by escritura pública before a notary, and later reforms extended the notarial route. So an Ecuadorian divorce may be a notarial deed rather than a judgment, and we name the instrument.
The marginal note, and the electronic certificate
The dissolution is recorded as a marginal note against the marriage inscription at the Registro Civil, and a certificate issued afterwards carries it.
Ecuadorian certificates are now issued electronically with a verification code and a QR, which is the normal form rather than a lesser one. We transcribe the code so the office can check it online.
The dissolution of the property regime
Ecuadorian law distinguishes the dissolution of the marriage from the liquidación de la sociedad conyugal, the winding up of the marital property regime, which is a separate act with its own instrument.
A couple may be divorced with the property regime unliquidated, and a US reader assuming one implies the other is assuming wrongly. We name each instrument.
The cédula, and two surnames
The cédula is ten digits with a province code and a check digit, and it stays with the person across a change of name or status.
