Registered locally, under a national act
Indian births are registered under the Registration of Births and Deaths Act, 1969, by the municipal corporation, the nagar palika or the gram panchayat of the place of birth. The certificate is issued by that local body, so the layout, the language and the paper vary enormously between states and decades while the legal basis is the same.
Many certificates are bilingual, with headings in English and the entries in Hindi, Marathi, Tamil, Gujarati, Kannada or another state language. The entries are the part carrying your name, your parents' names and the place, and a partly English form is not a translated document to the office receiving it.
When there is no certificate: the NABC
Plenty of Indian births were never registered, particularly outside cities and before the system was widely enforced. Where no record exists, the substitute is a Non-Availability of Birth Certificate, issued on Form 10 under the same Act after the registrar searches for the record and confirms there is none. It is typically filed together with secondary evidence such as an affidavit and school records.
The Department of State reciprocity schedule treats Indian birth certificates as obtainable from 1 April 1970, which is why filings involving births after that date are expected to produce either the certificate or the non-availability certificate. We translate either, along with the supporting affidavits.
What USCIS requires
The requirement is the same for every country: under 8 CFR 103.2(b)(3), a foreign-language document must be accompanied by a complete English translation and the translator's certification that it is accurate. Every seal, stamp and marginal note on your birth certificate is part of the document, so every one is translated.
