A Torrens system, which is unusual here
The Dominican Republic runs a Torrens registration system: the Certificado de Título issued by the Registro de Títulos is the title, and registered rights are in principle indefeasible.
That is a genuinely different system from most of Latin America, and a US reader may recognise it from Australian or Minnesota practice. The certificate, not the sale contract, is the document.
Registered and unregistered land
A great deal of Dominican land has never been through the saneamiento cadastral process and is held under unregistered possession with notarial acts and surveys instead of a certificate.
Those are different worlds with different risk, and clients present documents from both. We name which the document belongs to rather than calling everything a deed.
The designación catastral, and the survey
Registered property carries a designación catastral — parcel, district cadastral and municipality — and a plano approved by the Dirección de Mensuras Catastrales.
The parcel designation is the identifier and the survey plan is part of the record. We reproduce both references.
Foreign buyers, and the cédula
Foreigners may own Dominican property freely, which is unusual in the region, and much of the market is coastal and foreign-held.
Parties are identified by cédula de identidad y electoral or by passport, and the certificate states the marital regime. See our Spanish page.
