The poder, and the legalisation chain
A Dominican power is drawn up by a notary public — who in the Dominican Republic is a lawyer holding a notarial commission — and for use before many authorities the notary's signature must be legalised by the Procuraduría.
That legalisation is an extra step a US reader would not expect, and a power without it is refused by the office that requires it. We translate the legalisation stamp with the deed.
Property, and the Registro de Títulos
Dominican land runs on a Torrens registration system with certificates of title, and a power authorising a sale is examined by the Registro de Títulos alongside the title certificate.
So a property power travels with the title certificate reference, and we reproduce it. The Torrens system is unusual in Latin America and a US reader may recognise it from Australian or Minnesota practice.
Consular powers, and the diaspora
Dominican consulates exercise notarial functions, and with a very large US diaspora a great many Dominican powers are granted in New York, New Jersey and Florida.
A consular power is a Dominican notarial act. One signed before a US notary needs an apostille and then legalisation in the Dominican Republic. We name the issuing office.
The cédula, and the French inheritance
Parties are identified by cédula de identidad y electoral, written with separators that verification systems require.
