Eviction requires administrative authorisation
Venezuela's 2011 housing law requires a landlord to obtain administrative authorisation from SUNAVI, the housing superintendency, before any eviction, and to exhaust a conciliation procedure first.
So a Venezuelan tenancy file may contain administrative filings and resolutions rather than a court action, and a landlord who went straight to court has a problem. We name the body and the resolution.
Rent control, and the regulated amount
Residential rents have been subject to regulation, with SUNAVI setting or approving amounts by reference to the property, so the rent in the contract may be a regulated figure rather than a negotiated one.
Commercial letting is governed by its own 2014 statute with its own rules. We name which regime the contract falls under.
The currency problem
With three redenominations since 2008 removing fourteen zeros and widespread dollarisation in practice, a bolívar rent figure from a few years ago is not comparable to a current one and many contracts are now in US dollars.
