The FUA, and fast eviction

Peru created a special regime under which a lease executed on a Formulario Único de Arrendamiento and registered in a national rental registry gives the landlord an accelerated judicial eviction route.

So a Peruvian lease on that standard form is a different instrument from an ordinary private contract, with different remedies. We name the form and the registration.

Notarisation, and legalisation of signatures

An ordinary Peruvian lease is a private contract, and parties frequently have their signatures legalised by a notary or the contract raised to a public deed, which strengthens the landlord's position in an eviction.

The notarial legalisation is an endorsement on the document with the notary's name and register number, and we translate it rather than describing the page as notarised.

Soles and dollars, and the guarantee

Rent may be in soles or US dollars and the contract states which, with dollar rents common in Lima's larger market. We name the currency on the first line.

A deposit of one or two months is the norm and a fiador or aval is frequently required, whose identity details are on the contract. A guarantor is not a US co-signer and we describe the position.

The DNI, and the partida registral

Parties are identified by DNI, eight digits with a verification digit, which does not change and is the cross-check across a Peruvian file.
