The Civil Code, and the escritura
Guatemalan tenancy is governed by the Civil Code rather than a dedicated tenancy statute, and leases are frequently executed as a private contract with legalised signatures or as an escritura pública before a notary.
A notarial deed carries public faith and a strengthened position in an eviction. We name the notary and the register reference rather than describing the document as notarised.
Registration, and long leases
A lease of more than three years, or with rent prepaid for more than three years, may be registered at the Registro General de la Propiedad to bind a purchaser of the property.
An unregistered long lease binds the parties and not a buyer, which is a real consequence rather than a formality. We translate the registration endorsement where it exists.
Quetzales and dollars, and the deposit
Rent may be in quetzales or US dollars and the contract states which. We name the currency on the first line.
One or two months' deposit is the norm and a fiador is commonly required, frequently a property owner whose title details are attached. A guarantor is not a US co-signer.

Parties are identified by DPI with its thirteen-digit CUI, which does not change, and a company by its NIT.
