The oficina de inquilinato
Ecuadorian residential tenancy is governed by the Ley de Inquilinato, and municipalities maintain an oficina de inquilinato where leases are registered and where disputes are heard before a court.
So an Ecuadorian tenancy file may contain a municipal registration and an administrative proceeding rather than only a contract. We name the municipality and the office.
The rent ceiling, and the registration
The Inquilinato law sets a ceiling on rent by reference to the assessed value of the property for tenancies within its scope, and registration with the municipality is required for the landlord to rely on parts of the framework.
A registered lease and an unregistered one therefore put the parties in different positions. We translate the registration endorsement where it exists.
