The form follows the act
Polish law requires a power to be in the same form as the act it authorises, so a power to sell real property must be a notarial deed (akt notarialny) because the sale itself must be.
A private written power will do for many acts and not for that one. A power refused at a Polish notary is almost always refused for form, and we name which form the document takes.
The wypis, and the notary
What you hold is a wypis — an official issue of the notarial deed — not the original, which stays in the notary's files, and the wypis carries the notary's seal and the repertory number.
We say which on the certification and reproduce the notary's name, office and the repertory A number.
Powers granted abroad
A power granted in the United States for use in Poland is signed before a US notary and apostilled, and where the act requires notarial form the Polish side may require it to be granted before a Polish consul instead, who exercises notarial functions.
That distinction decides whether a Polish notary will act. We name the issuing office exactly.
Revocation, and the PESEL
A power is revoked by declaration to the attorney, and for registered acts the revocation should reach the registry. Polish powers commonly state an end date.
Parties are identified by PESEL and by identity document, and a company by its KRS number with the representation rule from the register. We reproduce each. See our Polish page.
