The notarial deed, and the levenstestament
A Dutch power for acts requiring a notarial deed — property transactions in particular — must itself be a notariële volmacht, and the instrument Dutch people most commonly hold is a levenstestament, a living will combining financial and medical authority for incapacity.
A levenstestament is a lifetime arrangement made to avoid court-appointed bewind or mentorschap, and reading it as a commercial power misses its purpose. We name the instrument.
The central register
The Netherlands maintains a Centraal Levenstestamentenregister in which notaries record that a levenstestament exists, so that it can be found when it is needed.
The register records existence rather than content. A registration confirmation may accompany the document and we translate it with the power.
Powers granted abroad
A power granted in the United States for use in the Netherlands is signed before a US notary and apostilled, and a Dutch notary will assess whether the form satisfies Dutch requirements for the act.
For a property transaction the Dutch notary generally requires a notarial power, so a simple notarised signature will not do. We say so rather than let a client assume it will.
The BSN, and the tussenvoegsel
Parties are identified by BSN, the citizen service number, and by identity document, and a company by its KvK number with the representation authority from the trade register extract.
Dutch surnames carry a tussenvoegsel — van, de, van der — which is part of the name, and the Netherlands alphabetises without it. See our Dutch page.
