The power has to be registered to work
A Peruvian power of attorney for most significant acts is granted by escritura pública and then inscribed at SUNARP, the public registry, in the Registro de Mandatos y Poderes.
The registry entry is what a notary, a bank or a buyer checks. An unregistered power for a registrable act is refused, and the partida number is what the other side actually reads. We reproduce it.
Vigencia de poder
Before acting, a Peruvian counterparty requires a vigencia de poder — a registry certificate confirming the power is current and has not been revoked — issued within a short period, commonly thirty days.
So a valid power with a stale vigencia is refused. That certificate, not the deed, is the operative document on the day, and applicants send the deed alone. We translate both.
Consular powers, and the diaspora
Peruvian consulates grant powers as notarial acts for use in Peru, and a power so granted is sent to Peru and registered there.
A power signed before a US notary and apostilled must also be protocolised by a Peruvian notary before registration. We name the issuing office, because the route determines the extra steps.
The DNI, and the enumerated faculties
Parties are identified by DNI, eight digits with a verification digit, and a company by RUC with its legal representative drawn from the registry entry.
