The notarial deed, and the Kadaster

A Dutch transfer is a notarial deed (leveringsakte) executed before a civil-law notary and registered at the Kadaster, and ownership passes on that registration.

What circulates is an afschrift of the deed plus a Kadaster extract. The property is identified by municipality, section and parcel number, not by address. We reproduce those.

Erfpacht, which is very common in Amsterdam

A great deal of Dutch urban property, Amsterdam above all, is held in erfpacht — a long leasehold over municipal land with a ground rent (canon) that is periodically revised.

Erfpacht is not freehold and the revision terms materially affect value. A buyer who reads the deed as ownership misprices the asset, so we keep the term and translate the canon clause.

The mortgage deed, and the bank guarantee

A Dutch hypotheekakte is a separate notarial deed registered at the Kadaster, and Dutch mortgages routinely secure an amount well above the loan.

The registered amount is therefore not the debt, and a reader who takes it as one overstates the encumbrance. We translate the registered figure and the clause that sets it.

Appartementsrecht, and the VvE

A Dutch flat is an appartementsrecht, a share in the whole building with an exclusive right of use, governed by a splitsingsakte and administered by the owners' association (VvE).
