The księga wieczysta, and its four divisions
Polish title lives in the księga wieczysta, a court-kept land and mortgage register with four divisions: the property, rights attached to it, ownership and perpetual usufruct, encumbrances, and mortgages.
The register enjoys a presumption of accuracy and protects a good-faith buyer. The divisions carry the meaning, and we keep them with their entry numbers.
Perpetual usufruct, which is not ownership
A great deal of Polish urban land is held in użytkowanie wieczyste — perpetual usufruct, a long term over state or municipal land with an annual fee — rather than freehold.
Much of it has been converted to ownership by statute since 2019, but older deeds and many commercial plots still carry it. Translating it as ownership misstates the title. We keep the term.
The notarial act, and the electronic register
A Polish transfer is a notarial act, void without that form, and the notary files for the register entry. The register is searchable online by its number, which has a court code and a check digit.
We reproduce the full register number including the check digit, because a number without it cannot be looked up.
The PESEL, and the restitution history
Parties are identified by PESEL, eleven digits encoding date of birth and sex with a check digit, and a company by KRS and NIP.
Polish title can carry a long post-war history of nationalisation and restitution claims, and the register may note pending proceedings. See our Polish page.
