General and special, and the stamp duty
An Indian power is a general power of attorney or a special power of attorney for a named act, and it is executed on stamp paper of a value set by state law — the stamp is what makes it admissible in evidence.
An insufficiently stamped power can be impounded. We transcribe the stamp paper details and the duty paid in full.
Registration, and property
A power authorising the sale of immovable property is generally required to be registered with the sub-registrar, and a Supreme Court decision curtailed the practice of transferring property by general power of attorney in place of a sale deed.
So a general power presented as evidence of ownership will not do what a US reader might assume. We name the instrument and reproduce the registration details where they exist.
Executed abroad, and the adjudication
A power executed in the United States for use in India is signed before a notary or an Indian consulate, apostilled or consularised, and then must be stamped in India within three months of arrival or it becomes inadmissible.
