General and special, and the escritura
Colombian law distinguishes a poder general, which must be granted by escritura pública before a notary, from a poder especial for a named act, which may be a private document with the signature authenticated.
A general power that was not made by public deed is not a general power. We name the instrument and reproduce the enumerated faculties clause by clause.
The presentación personal
A Colombian private document gains effect through presentación personal — the signatory appearing before a notary who records that they presented and recognised the document.
It is not the same as a US acknowledgment and it is not a full notarial deed. The stamp records the notary, the date and the act, and we translate it rather than describing the page as notarised.
Powers granted at a consulate
Colombian consulates exercise notarial functions, so a power granted before a Colombian consul in the United States is a Colombian notarial act rather than a US notarisation with an apostille.
Colombian notaries and registries treat the two differently, and with a large diaspora consular powers are very common in these files. We name the consulate exactly.
Revocation, and the cédula
A power is revoked by a further notarial act, and notice to the attorney and to third parties matters for acts already begun.
