Escritura and folio, which are two documents

A Colombian transfer is an escritura pública before a notary, and it is registered at the Oficina de Registro de Instrumentos Públicos, which opens a folio de matrícula inmobiliaria for the property.

The certificado de tradición y libertad is the extract of that folio, and it is the document that shows the ownership history and the encumbrances. The escritura alone does not.

The certificado de tradición, entry by entry

The certificate lists numbered anotaciones in order: each transfer, mortgage, embargo, patrimonio de familia, afectación a vivienda familiar and condición resolutoria.

Several of those restrict a sale without a court order or a spouse's consent, and they are easy to miss in a summary. We translate every anotación with its number and date.

The false tradition entry, which surprises people

A folio may carry a falsa tradición annotation — the registered party transferred rights they did not fully hold, commonly from inheritance or possession rather than full title.

It is a real, recorded status and not a fraud finding, and it materially limits what can be sold. We translate the term and explain it rather than rendering it as "false title".

The cédula, and the cadastral number

Parties are identified by cédula de ciudadanía and a company by NIT, and the property by its matrícula number and the cadastral reference.
