The escritura, and the Registro de la Propiedad

A Spanish transfer is an escritura pública before a notary, inscribed at the Registro de la Propiedad, and the registry is constitutive in practice for protection against third parties.

The deed carries the notary's protocol number and the registry the finca number, volume, book and folio. We reproduce all of them.

The nota simple, which is what people actually send

The commonest Spanish property document in a US file is a nota simple — an informative registry extract giving the owner, the description, the charges and the mortgages.

It is informative and not certifying; a certificación registral is the certifying form. Those are different documents with different weight and we name which one you have.

Two references for one property

Spain runs the registry and the cadastre as separate systems with separate identifiers, and the registry description and the cadastral one can disagree on surface area.

That mismatch is common and is not an error in the translation. We give both references and the discrepancy, because a buyer or a court needs to see it.

The NIE, and the charges

A foreign owner is identified by NIE and a Spanish one by DNI, and the registry lists cargas — mortgages, embargos, easements and afecciones fiscales for unpaid transfer tax.
