No legal separation, and two divorce routes
Ukrainian law provides no legal separation as a status. Where there are no minor children and both spouses agree, divorce is registered at the DRATsS civil registration office after a one-month waiting period, with no court.
Where there are minor children or a dispute, a court is required and the judgment must then be registered. So a Ukrainian file may hold a registry certificate, a judgment, or both.
Separate residence by court order
Ukrainian family law does allow a court to establish a regime of separate residence for spouses, which suspends the presumption that a child born afterwards is the husband's and affects property acquired during it.
That is the closest Ukrainian equivalent to a legal separation and it is uncommon. Where the document exists we translate it as what it is rather than as a divorce.
Wartime, and divorce at a distance
Since 2022 Ukrainian courts and registry offices have operated under wartime conditions, with proceedings conducted remotely, documents issued through Diia with electronic signatures, and consular registration abroad.
A Ukrainian divorce document from this period may carry an electronic signature rather than a wet stamp. We describe it as what it is rather than treating the absence of a seal as a defect.
The certificate, the patronymic and the surname
The registry issues a certificate of divorce on a numbered form, and a spouse may revert to a pre-marriage surname, with the choice recorded.
Names carry a patronymic from the father's given name, which is not a middle name, and Ukraine's 2010 transliteration may mean an older document spells the Latin name differently. See our Ukrainian page.
