Personal status follows religion, and there is no civil separation
Pakistani family law applies the personal law of the parties' religion, and for Muslims the Muslim Family Laws Ordinance 1961 governs. There is no civil legal separation of the European kind.
What exists is divorce by talaq, khula by court, and judicial dissolution on statutory grounds. Each produces a different instrument and we name which the document is.
The Union Council, and the ninety days
A talaq is not effective on pronouncement. Notice must be given in writing to the chairman of the Union Council, which constitutes an arbitration council, and the divorce takes effect ninety days after that notice unless reconciliation occurs.
The Union Council then issues a divorce effectiveness certificate, and that certificate — not the talaq deed — is what evidences a completed divorce. A file with a talaq deed and no certificate evidences an incomplete process.
Khula, and the court route
A wife may obtain khula from a family court, ordinarily returning the dower, and dissolution on statutory grounds is available under the Dissolution of Muslim Marriages Act 1939.
Those produce a court decree, which is then also sent to the Union Council for registration. Both documents belong in the file.
The nikahnama, and the registration
The marriage itself is evidenced by the nikahnama, the marriage contract registered with the Union Council, whose clauses may include a delegated right of divorce to the wife.
