The deposit is capped at three months

The Turkish Code of Obligations caps a residential tenancy deposit at three months' rent, and where it is money it must be placed in a savings account at a bank not withdrawable without both parties' consent or a court order.

A Turkish lease demanding more, or a landlord holding the deposit personally, is outside the statute. We translate the clause as written, and the bank arrangement where the lease specifies one.

Rent increases, and the 25% period

Annual increases on renewal are capped at the twelve-month average of the consumer price index. Between 2022 and 2024 Turkey additionally imposed a temporary statutory ceiling of 25% on residential rent increases regardless of inflation.

So a lease from that period may contain an increase clause the law overrode. A reader comparing the contract to what was actually paid needs to know why they differ, and we note the clause exactly as the contract states it.

Notarisation, and eviction commitment

Leases are commonly not notarised, but a tahliye taahhütnamesi — a written undertaking by the tenant to vacate on a stated date — is a distinct instrument that, if validly given, allows enforcement without a full eviction action.

It is frequently signed at the start of the tenancy and dated later, which has generated substantial litigation. Where one appears in a file we translate it as the separate instrument it is rather than as a clause of the lease.

Aidat, and what the tenant pays

Building service charges (aidat) are usually paid by the tenant and are separate from rent, and the lease allocates them along with utilities and the earthquake insurance premium (DASK), which is compulsory.
