Najem okazjonalny, and the notarial submission

Poland offers a special tenancy form, najem okazjonalny, available to private individual landlords, in which the tenant makes a notarial declaration submitting to enforcement and names an alternative address they can move to, with that address owner's consent.

It lets the landlord evict without a full court action, and it is registered with the tax office. A file therefore contains the lease, a notarial deed and two declarations — and a US reader given only the lease has a fraction of it.

The ordinary tenancy is strongly protected

An ordinary Polish residential tenancy is protected by the tenant protection act, which limits notice, requires grounds and bars eviction into homelessness during the winter protection period without a substitute premises being available.

Which form the tenancy takes therefore decides the tenant's security entirely, and the contract says which. We name it rather than describing the document as a lease.

Kaucja, and the cap

The deposit (kaucja) is capped at twelve times the monthly rent for ordinary tenancies and six for najem okazjonalny, though in practice one to two months is the market norm.

The statutory cap is far above market practice, which surprises readers who assume a low cap means low deposits. We translate the figure as the contract states it.

The protokół, and the meldunek

Polish tenancies are handed over with a protokół zdawczo-odbiorczy — a handover record listing the condition and the meter readings — which is an annex to the lease and is what damage deductions are assessed against.
