Three years, and why leases stop there
A Thai lease of more than three years must be registered at the land office to be enforceable beyond three years, so an enormous share of Thai leases are written for exactly three years with renewal options.
That is a deliberate structure rather than a short tenancy. A thirty-year lease exists and is registered, and it is the instrument used where a foreign national cannot own the land.
Foreigners cannot own land
Foreign nationals may own a condominium unit within a building quota but generally cannot own land, so long registered leases — frequently thirty years with renewal promises — substitute for ownership.
An unusually long Thai lease in a foreign national's file is therefore a substitute for ownership rather than an oddity, and we translate the term and renewal structure carefully because they are the whole value.
The deposit, and the 2018 consumer rules
Consumer protection rules introduced in 2018 for landlords letting five or more units cap the deposit at one month and advance rent at one month, and restrict several common clauses.
So a lease from a large landlord and one from a private owner sit under different rules. We translate the clause as written and do not annotate enforceability.
