Folio real, and an open registry
Panama runs a folio real system at the Registro Público with a finca number per property, and the register is searchable online, which is unusual in the region.
The finca number plus the section and province is the citation, and a counterparty is expected to check it. We reproduce the citation exactly.
Rights of possession, which are not title
A large share of Panamanian land, especially in Bocas del Toro and on the islands, is held as derechos posesorios — rights of possession over untitled state land, recorded by ANATI rather than the property registry.
A right of possession can be sold and can be titled, but it is not title and it carries real risk. Foreigners face restrictions on holding it near borders and coasts. We name the tenure as it is.
Corporate holding, and the PH
Panamanian property is very commonly held through a corporation or a private interest foundation, so the deed names a company and the real question is who controls the shares.
An apartment is held under propiedad horizontal with a registered reglamento de copropiedad and a participation share. We translate both.
The comarcas, and the identifiers
The indigenous comarcas hold collective land that cannot be individually titled, and documents from them are not deeds.
