State civil codes, and a Mexico City minimum
Leases are governed by state civil codes, so the minimum term, the deposit practice and the eviction procedure differ across the country. Mexico City's code sets a minimum residential term of one year.
We name the state, because a lease that is unremarkable under one code may be irregular under another and a reader cannot tell from the document alone.
The fiador, and the property pledged
The standard Mexican guarantee is a fiador who owns unencumbered real property, and the lease attaches the property's escritura details, the folio real and frequently the boleta predial, the property tax receipt.
A póliza jurídica from a specialised company is the increasingly common alternative, sold as an insurance-style product. The lease says which, and the guarantor's property description is part of the document we translate.
Depósito, and what it usually is
One month's deposit is the market standard rather than a statutory rule, and the lease sets the conditions for its return. Mexican leases commonly also require rent to be paid in advance.
A landlord who is an individual withholds and remits tax on rental income and issues a CFDI — a digital tax receipt — which is the document that evidences payments actually made. It is more useful than the lease for proving a payment history.
Ratification, and proof of address
A lease may be ratified before a notary or a Registro Público, which is not required for validity but strengthens it and is sometimes required by an office receiving it.
