The point system decides the maximum rent
Dutch housing is scored under a woningwaarderingsstelsel — a point system rating size, facilities, energy label and location — and for regulated dwellings the points set a legal maximum rent. A landlord charging above it can be made to reduce it retrospectively.
So the rent in a Dutch lease is not necessarily the lawful rent, and a tenant can check it. We translate the points schedule where it is attached, because it is the part that tells a reader whether the rent is enforceable.
The Huurcommissie, and the six-month window
The Huurcommissie is a statutory body that rules on rent levels, service charges and maintenance disputes, and a tenant can challenge the initial rent within six months of the tenancy starting.
A Dutch file may therefore contain a Huurcommissie decision altering the rent, which supersedes the contract on that point. We translate the decision alongside the lease.
Fixed-term tenancies were largely abolished
The Netherlands permitted short fixed-term tenancies from 2016 and then largely abolished them again from 1 July 2024, making indefinite tenancies the rule with limited exceptions.
So a two-year fixed-term contract signed in 2022 and one signed in 2025 sit in different regimes, and the date is the first thing a reader needs. We put it where it cannot be missed.
Kale huur, servicekosten and huurtoeslag
Dutch rent is quoted as kale huur — bare rent — with servicekosten separate, and the distinction matters because huurtoeslag, the housing benefit, is calculated on the bare rent plus a limited set of eligible charges.
