The perito tercero en discordia
Mexican procedure commonly has each party name its own perito. Where the two dictámenes disagree, the court appoints a perito tercero en discordia — a third expert in discord — whose opinion resolves the conflict.
That is a structure with no US equivalent, and a file containing three expert opinions is not three competing hired experts. The third is the court's and it is decisive. We name it on the first line.
The dictamen, and the perito's cédula
The report is a dictamen pericial, and the expert's authority rests on their cédula profesional — the federal professional licence number — and, for court work, registration with the Consejo de la Judicatura or the state judiciary.
The cédula is how the expert is verified and it is reproduced exactly. A dictamen from someone without the registration is a different document and the reader should be able to tell.
Ratification before the court
A Mexican dictamen generally requires ratification — the expert appearing before the court to confirm the report and answer questions — and the ratification appears in the file as its own act.
An unratified dictamen may carry little weight. We translate the ratification record where it exists rather than only the report.
