The 2012 code moved to party-appointed experts
The Código General del Proceso reversed the traditional model: the expert opinion is now ordinarily commissioned and paid for by the party relying on it and filed with their pleadings, with court appointment reserved for defined situations.
So a Colombian dictamen pericial is frequently a party expert, which is closer to US practice than the rest of Latin America and the opposite of what a reader familiar with the region will assume. We say which it is.
What the code requires the report to contain
The code prescribes the content: the expert's qualifications and professional registration, a list of every case in the last four years in which they have acted as an expert, who is paying them and how much, the methodology, and a declaration of independence.
Those disclosures are statutory requirements and their absence is a ground of challenge. A translation that drops them as preliminaries has removed the part a court checks first.
Contradicción, and cross-examination
The opposing party exercises the derecho de contradicción by filing a contrary opinion, by requesting the expert's attendance at the hearing, or both, and the expert is then examined orally.
So a Colombian expert file may contain two party reports and a transcript of the examination. We translate the sequence rather than the winning report alone.
Loss of working capacity, and the juntas
Medical incapacity in Colombia is assessed under the Manual Único de Calificación as a pérdida de capacidad laboral percentage, by an EPS, an ARL, a pension fund or a Junta de Calificación de Invalidez, with an appeal chain to regional and national juntas.
