Certified Japanese Power of Attorney Translation

The inkan is the signature

A Japanese power of attorney (ininjō) is executed with a registered seal — the jitsuin — rather than a signature, and it must be accompanied by an inkan shōmeisho, the municipal certificate proving the seal is the registered one.

Without that certificate the seal proves nothing. A US reader receiving a document with a red impression and no certificate has an incomplete instrument, and we say so rather than describing the page as sealed.

Japanese living abroad have no seal registration

Seal registration is tied to resident registration in a Japanese municipality, so a Japanese national living in the United States cannot obtain an inkan shōmeisho.

The substitute is a signature certificate (sain shōmei) issued by a Japanese consulate, which certifies the signature in place of the seal. That is the document to obtain, and applicants frequently do not know it exists.

The koseki, and inheritance powers

A very large share of Japanese powers in US files concern inheritance, where an heir abroad authorises a relative to handle an estate, and the Japanese side requires the full koseki chain establishing the heirs.

So the power travels with family register extracts, and computerisation left older entries in the kaisei genkoseki. We translate the set consistently.
