There is no civil marriage or divorce
Israel has no civil marriage and no civil divorce. Jewish marriage and divorce fall to the rabbinical courts, and Muslim, Christian and Druze matters to their own religious courts. A civil family court handles property and children but cannot dissolve a marriage.
So there is no legal separation decree in the European sense. What exists is a religious dissolution and, alongside it, civil court orders on everything except the marital bond itself.
The get, and the agunah problem
A Jewish divorce requires the husband to grant a get and the wife to accept it. A woman whose husband refuses is an agunah — chained — and remains married indefinitely regardless of how long they have lived apart.
That is why an Israeli file may show a couple separated for many years with no divorce, and it is not evidence of a subsisting relationship. We translate the rabbinical court record as what it says.
Civil orders alongside the religious one
The civil family court issues orders on maintenance, property division and custody, and a couple may hold a full set of those with no divorce at all. Those orders function much as a separation decree does elsewhere.
So a US office asking for separation papers should be sent the civil court orders, and we name the court and the instrument rather than presenting them as a divorce.
Foreign marriages, and registration
Israelis who cannot marry under religious law frequently marry abroad, commonly in Cyprus, and the marriage is registered by the population registry without being recognised as a religious marriage.
