The full-effect declaration
Hungarian acknowledgment is the teljes hatályú apai elismerő nyilatkozat — the paternal acknowledgment declaration of full effect — made before a registrar, a guardianship authority, a court or a notary, and it may be made before the birth.
It requires the mother's consent, and where the child is over fourteen the child's consent as well, and where the mother is a minor her legal representative's. So a complete Hungarian file contains more than one declaration.
It cannot be made against a presumption
The declaration cannot be made while another man is presumed to be the father — the husband or a previously acknowledged man — and that presumption must be set aside first.
So a refused acknowledgment in a Hungarian file usually means an existing presumption rather than a substantive objection. We name what the instrument says.
The surname, and the married name forms
On acknowledgment the parents may agree the child's surname, and Hungarian family naming is complicated by the several permitted married name forms including the -né suffix.
A mother may appear on an older document under a form containing none of her own name. We explain the form rather than transliterating it into something meaningless.
Surname first, and the registry
The acknowledgment is recorded in the electronic civil registry and an anyakönyvi kivonat issued afterwards shows the father.
