Recunoaștere, in three forms
Romanian recognition of a child (recunoașterea copilului) may be made in the birth declaration, by authentic act before a notary, or by will, and it is irrevocable once made.
It may also be made before the birth or after the child's death in defined circumstances. We name which form the instrument takes and reproduce the notary and act number.
The presumption, and the action to establish
A child born during marriage is presumed the husband's, and recognition by another man is not possible until that presumption is set aside. Where a father does not recognise, an action to establish paternity lies.
The judgment is then recorded against the birth act. A judgment alone does not amend the record, and we name each instrument.
The mențiune on the birth act
The recognition is recorded as a mențiune against the act de naștere held by the local registry, and a certificat de naștere issued afterwards shows the father.
A short certificate may show the current state without the history, so where the sequence matters ask for the extract showing the mențiuni.
The CNP, and the surname
The CNP — thirteen digits encoding sex, century and date of birth and the county of registration — identifies each person and does not change with filiation.
The child may take the father's surname by agreement, recorded in the same act. Romanian-language documents also come from Moldova and we name the issuing state. See our Romanian page.
