Freehold barely exists
Almost all Myanmar land is held from the state under a grant, lease or permit, and the classes are distinct: grant land (a long lease, mostly in Yangon), freehold (rare, largely pre-colonial), agricultural land held under a Form 7 land use certificate, and various permits.
The class is the value of the asset. Translating any of them as ownership misstates it, and we keep the class as written.
Form 7, and what it does not allow
Agricultural land is held under a Form 7 land use certificate, which permits transfer only to persons who will continue farming and requires approval, and using the land for anything else needs formal conversion.
A buyer who reads Form 7 as a deed misjudges what can be done with the land entirely. We translate the conditions on it.
Foreigners, and the condominium law
Foreigners cannot own land in Myanmar, and leases to foreigners historically needed approval above one year. The 2016 Condominium Law allows foreign ownership of units above the sixth floor within a forty per cent building cap.
That is the only route to foreign ownership and the file will show the building's registration. We translate it.
Stamp duty, names and the units
An under-stamped instrument is inadmissible, and registration is at the Office of Registration of Deeds.
