Stamp duty, and registration
A Myanmar power is executed on stamped paper and, for immovable property, registered at the Office of Registration of Deeds, where the register number and the stamp value both appear on the instrument.
An under-stamped power is inadmissible rather than merely irregular, which is a harsher consequence than a US reader expects. We reproduce the stamp and the registration details.
Powers granted abroad, and the legalisation chain
Myanmar is not a party to the Apostille Convention, so a US document goes through notarisation, Department of State authentication and legalisation by the Myanmar embassy.
The route has been disrupted since 2021 and practice varies by office. We translate the endorsements the document carries and name the issuing authority rather than asserting what a receiving office will accept.
Land, which is mostly not freehold
Most land in Myanmar is held under grant, lease or permit rather than freehold, and a power concerning land refers to the class of tenure.
Translating the instrument as a power to sell land misstates it. We keep the tenure vocabulary as written, because the class of tenure is the legal position.
Names, and the absence of surnames
Burmese names have no surname and no family line: the honorific U, Daw, Ko or Ma is a title of address, not part of the name, and a US form that files "U" as a first name produces a mismatch.
