Quesitos, and who gets to ask
A Brazilian perícia is structured around quesitos — written questions submitted in advance by the judge and by each party, which the perito judicial must answer individually and in order.
So the report is not a narrative opinion, it is a set of numbered answers, and the numbering matters because a party may complain that a quesito went unanswered. We keep the numbering and the attribution of each question exactly as the report sets them out.
Assistentes técnicos, and the divergent opinion
Each party may appoint an assistente técnico who accompanies the perito's work and files a parecer, which may agree or diverge. The divergent parecer sits in the file alongside the official report.
A US reader given three documents sees three experts disagreeing. In Brazilian procedure there is one court expert and two party assistants, and we say which is which.
The perito's registration and the honorários
The perito is appointed by the judge and must hold registration with the relevant professional council — CRM, CREA, CRC — and the report states it. The report also records the fees fixed by the court, which appear in the file.
The council registration is how the expert is verified and we reproduce it exactly rather than describing them as a qualified professional.
INSS medical perícia, which is a different thing
A great deal of Brazilian expert material in US files is not litigation at all but INSS medical perícia — the social security assessment for sickness and disability benefits — which follows its own procedure and produces its own form.
