Perito de oficio, sorteado from the lists
An Argentine perito de oficio is drawn by lot (sorteo) from lists held by the court, from professionals registered with their consejo or colegio for that judicial district. The appointment order names them and records the draw.
The lot is the point: the expert is not chosen by anyone with an interest, and that is what gives the report its standing. We translate the appointment and the draw rather than describing the expert as court-appointed.
Puntos de pericia, and the consultor técnico
The parties propose puntos de pericia — the matters to be examined — and the court settles them. Each party may also appoint a consultor técnico, who is not an expert of the court but a technical adviser entitled to attend and to file observations.
The report answers the puntos in order and the consultores' observations follow. We keep the structure and the attribution.
Impugnación, and the pedido de explicaciones
A party may file a pedido de explicaciones asking the expert to clarify, or an impugnación challenging the report, and the expert's written response is part of the file.
So an Argentine expert file is frequently a sequence — report, challenge, response — and translating only the first leaves out the part where the conclusion was tested. We translate the sequence with dates.
Medical scales, and the baremo
Argentine medico-legal reports assess incapacity as a percentage against a baremo — a statutory or professional impairment table — and the applicable baremo differs between labour law, civil liability and social security.
