Afghan family law applies Islamic law as codified, principally in the 1977 Civil Code for the Sunni majority with Shia personal status law applying separately since 2009. There is no civil legal separation.
What exists is divorce by talaq pronounced by the husband, khula by agreement with compensation, and judicial dissolution (tafriq) on defined grounds. We name which the instrument records.
Registration, and the documents that exist
Marriage and divorce registration has historically been partial in Afghanistan, and many marriages were never registered at all — evidenced instead by a nikahnama witnessed by the community.
So an Afghan divorce may be evidenced by a court document, a nikahnama annotated by a court, or witness attestations. We name the body that issued each and describe the document for what it is.
Solar Hijri dates, and courts that moved
Afghan documents are dated in the Solar Hijri calendar, whose year begins at the spring equinox, and we convert each date individually.
Documents issued since 2021 come from courts operating under a changed administration, and documents from before that from the previous one. We name the issuing court exactly as printed, without commentary.
Dari, Pashto, and documents from abroad
