The Union Council and the ninety days
Bangladesh applies the Muslim Family Laws Ordinance 1961 for Muslims, and a talaq is not effective on pronouncement: written notice must go to the chairman of the Union Council or the municipal equivalent, and the divorce takes effect ninety days later unless reconciliation occurs.
The council then issues a certificate of effectiveness. A file with a talaq deed and no certificate evidences an incomplete process, and that is the commonest defect.
Khula, and the delegated right
A wife may obtain khula by agreement or apply to the family court for dissolution on statutory grounds, and the nikahnama may delegate the right of divorce to her — clause eighteen of the standard form.
Whether that clause was completed changes what routes are available, and it is on the marriage contract. We translate the clause rather than skipping it as a form field.
Hindu and Christian marriages
Bangladesh has no divorce for Hindu marriages, which are treated as indissoluble under the applicable personal law, and Christian marriages are governed by their own statute with restrictive grounds.
So a Hindu Bangladeshi couple may be separated for decades with no legal instrument, and a US office waiting for a decree is waiting for a document that will not exist.
English, and the registration
Bangladeshi legal documents are largely in English, so a translation may be unnecessary — ask the office first. The nikahnama itself is frequently in Bangla.
