Talaq, khul' and court divorce

Under the Muslim Personal Status Act of 1991 a husband can divorce by talaq without going to court, while a wife must apply to the court, either for a judicial divorce on grounds the Act lists or for khul', where she gives up financial rights in exchange. Each route produces a different document: a recorded talaq, a khul' document or a court judgment.

Divorce certificates, Islamic or not, are issued under the Judiciary on the documents of whoever conducted the divorce, and only for divorces in Sudan. A wife's court case can produce several papers, the judgment and later orders, each with its own date. See our Arabic page.

Revocable or final, and authentication

A first or second talaq is often revocable during the waiting period ('idda), so the document may say whether the divorce is revocable (raj'i) or final (ba'in). We translate that wording exactly rather than reducing it to "divorced", because a US office may need to know when the marriage actually ended.

The Sudanese embassy in London says divorce documents must first be authenticated at the Ministry of Foreign Affairs in Khartoum; USCIS does not ask for this. The names should match the Sudanese marriage certificate, and for a separation without divorce see the legal separation page.

What USCIS requires

Under 8 CFR 103.2(b)(3), a foreign-language document must be accompanied by a complete English translation and the translator's certification that it is accurate. Every seal, stamp and marginal note is part of the document, so every one is translated.

State agencies set their own rules — see government agencies — and what our certification states is on this page.

How it works

Upload a photo or a scan of your document, pick the language pair and check out online. You never have to mail originals: a legible copy is all we need.

A professional human translator, never machine translation, translates the document word for word and mirrors the layout of the original. Every certified translation ships with a signed Certificate of Translation Accuracy that meets the requirements of USCIS, courts and universities.

Your translation is delivered digitally, usually within 24 hours for documents of one to three pages, and same-day delivery is available. If anything needs adjusting, we revise it.

Certified vs. standard translation

A certified translation is a word-for-word translation accompanied by a signed statement attesting to its accuracy and completeness. It is what official bodies require: USCIS, courts, universities and government agencies. Certified translations are $24.95 per page, where one sheet of your document is one page, with no word cap.

A standard translation is the same professional human translation without the certificate, for when you only need to understand the content or for internal or informal use. It is billed at the same $24.95 per page with no word cap.

Frequently asked questions

My divorce was a talaq with no court involved.

That is lawful under the 1991 Act. We translate the document that records it, whoever issued it.

The document says the divorce is revocable.

We translate that term as written. Ask the receiving office whether it also wants proof that the waiting period ended.

I divorced abroad but married in Sudan.

Sudanese divorce certificates cover divorces in Sudan only. Your foreign divorce document is translated, if needed, on its own.
